A husband and wife are suing the Marshall University Board of Governors in a slip and fall lawsuit. The plantiff fell on the Marshall University Campus and broke her ankle. Her husband is suing for damages as well.

Sheila Marks claims she was walking on campus Sept. 8, 2005, at the entrance of the Memorial Student Center, when she tripped and fell on a raised curb. She was injured, including a fractured right ankle.

Marks claims the Board of Governors failed to properly maintain the sidewalk and remove any obstacles.

The lawsuit was filed in Kanawha Circuit Court and will be heard by Judge Tod Kaufman. There was no comment from the University on the case.
